Cul de Sac School: the COM is still not owner of the land
In the 2000s, the town hall decided to expand the school of Cul de Sac, but the construction site was not located on a land belonging to the COM, but to individual owners, the Malortigue brothers. When they found it out, they reclaimed their property before the Courts. The case is ongoing for 11 years now. Recently, the COM has been successful and a declaration of public utility (DUP) has been notified. The prefect issued a decree in this sense. But the Malortigue brothers appealed this decision and required the Administrative Court of St. Martin in early 2016 to have it cancelled. And the Court did so. The COM is supposed to restore the land to its original condition.
Thus, on January 19, 2017, the COM decided to launch a new procedure of declaration of public utility (DUP). The Territorial Council enacted this decision.
As it is not the owner of the land, the COM cannot obtain funding and grants.
