Grand Case beach chair case: the public rapporteur has requested that the decision be cancelled

The Grand Case beach chair case was examined by the Administrative Court this morning. The public rapporteur has requested that the executive council’s decision of November 17, 2015 be cancelled on the grounds that it was not competent to make this type of decision. The public rapporteur drafted his conclusions based on the executive council’s role and competences contained in the organic law. The executive council may make a decision if it has been requested on an individual basis, if it comes from a proposal of the president of the territorial council or if it falls within their direct authority. According to the public rapporteur, the decision of November 17, 2015 does not correspond to any of these conditions.
The judgment has been adjourned until June 24.
