Resident permit: the Collectivité will send a notice of its issuance

THE COLLECTIVITÉ WILL BE CONSULTED BY THE PREFECTURE REGARDING THE RESIDENT PERMIT ISSUANCE RECORDS.

With 15 votes in favor, the Territorial Council passed on Thursday the implementation of a consultative commission in charge to decide on the Republican integration of a foreign person seeking a first resident permit, a permit issued by the State to people having already obtained residence cards.

The role of this commission will be to “deliver an opinion in compliance with the condition of Republican integration from abroad in French society.” "This condition will rely in particular on his personal commitment with respect to the principles that govern the French Republic, the effective observance of these principles and his knowledge of the French language", as it is stated in the deliberation. The commission will rely on "reliable and up-to-date information by the Directorate of Legal Affairs and Litigation within internal departments to the Collectivité or from partner services likely to have information about the aliens concerned."

If the commission does not take a decision within two months of being seized by the prefecture, the latter will consider the opinion of the Collectivité as positive.

On behalf of the Union for Democracy (UD), Daniel Gibbs deems that elected officials should not be part of this commission at the risk of being the target of criticism and be instrumentalized.
Furthermore, “if the services of the State and the Collectivité have studied the records”, the leader of the opposition does not see the need of such commission. The opposition group did not consent to its establishment.

In 2015, 225 resident permits were granted against 575 three years earlier.
